Title:	論數位教材的著作財產權歸屬管理

Abstract:	數位教材是透過網路進行數位學習時所使用的教材內容。當數位教材成為重要的教學工具時，在考慮網路資訊流通所造成的著作權侵害問題的情況下，許多數位教材保護科技不斷產生。然而，最根本的議題還是誰才是著作財產權人。因此，本文意在研討如何確保數位教材出版者能擁有完整的著作財產權。數位教材的著作財產權歸屬管理是本文所欲探討的概念。本文主要有三部分：分析數位教學創作內容的創作過程、著作財產權的基本概念、以及著作財產權歸屬管理。本文的重點在提出著作財產權歸屬管理的概念，從創作人管理、著作財產權歸屬契約、和發表管理等三方面來闡述。創作人管理在確立誰是原著作人，而接著才能透過著作財產權歸屬契約來將原作人所擁有的著作財產權轉讓給數位教材出版者。至於發表管理則是形成一些未抄襲他人著作的證據。
