Title:	行政機關「標準作業流程」之法律性質──以臺北市政府網站公告之SOP為中心

Abstract:	行政機關為執行具持續性或反覆性特徵之特定行政任務，就相關作業以流程圖示方式所訂定之「標準作業流程」（SOP），在實務上因多未踐行下達程序，故多不被定性為行政程序法第159條所稱之行政規則，毋寧僅視為是單純之行政內部作業文件而已。然此等具一般、抽象規範特性之行政SOP若已於行政機關網站上公告，本文認為應肯認其具有下達之替代性功能，而可認定業已踐行行政程序法第160條所規定之生效要件，屬「已生效之行政規則」；對於訂定機關、下級機關及屬官皆有拘束之效力。更甚者，若行政SOP依其規範內容具有間接外部效力者，則違反該類行政SOP所作成之行政決定的相對人或利害關係人，更可以違反平等原則及其所衍生之行政自我拘束原則為由，指摘具體行政決定之違法性。
