    Title: Gender Mainstreaming and the Protection of Women’s Personal Safety: Beginning with the Expericence in Taiwan

    Abstract: 本文的目的在於說明過去16年來，臺灣的個人（包括被害女性、關心這個議題的學者以及專業工作者律師與社會工作者）以及不同的民間婦女團體，如何透過社會運動、訴訟與論述的途徑，改變臺灣社會中女性人身安全的處境。這些改變的方法包括推動立法、給予臺灣當局改變政策的壓力、透過論述改變觀念等。限於篇幅與時間，本文將著重討論跟女性人身安全有關的立法背景、影響立法的個案、立法內容以及立法之後這些法規在實際運作時的成效，最後並將討論這些立法跟法學研究與教學的關係。過去16年來，臺灣地區牽涉婦女權益的立法大約有9個。其中跟女性人身安全保障有關的立法大約有7種，分別是：1995年通過“兒童及少年性交易防制條例”、1997年通過“性侵害犯罪防治法”、1998年通過“家庭暴力防治法”、1999年通過“刑法妨害性自主罪章”、2002年通過“兩性工作平等法”、2004年通過“性別平等教育法”、2005年通過“性騷擾防治法”。其中，“兒童及少年性交易防制條例”，對於女性人身安全的保障是否有達到立法的目標，值得懷疑。因此本文將暫時對此一法規不加以討論。本文將嘗試從“性別主流化”(gender mainstreaming)的觀點，討論上述相關立法。所謂性別主流化的觀點是指，從性別角度出發，分析跟女性人身安全保障有關的立法的內容及其影響。本文希望分析，臺灣的民間婦女團體如何從保護女性人身安全的觀點出發，影響立法者的立法，並將探討法律在改變社會既有文化的功能上，其可能的手段與極限。最後，本文將分析跟女性人身安全保障有關的立法可以如何影響臺灣法學教育與研究。
