    摘要: 肯定事業間有競爭關係,並不表示事業所成立之專利聯盟就當然違法,因為仍有視其具體內容與其對市場之影響,給予例外許可之可能。但否定事業之競爭關係,就阻斷對專利聯盟進行聯合行為管制之一切可能。競爭關係是聯合行為之成立要件,專利聯盟對市場之影響,往往要審查個案情形後始能決定,故我們在處理的基本立場上,不宜輕易否定事業之競爭關係,以致在一開始就排除公平會對其監督審查之可能。在專利聯盟對市場競爭之影響遠高於個別專利授權,以及本案依公平法上其他規定處理之妥適性顯具有疑義之際,儘量不否定聯合行為之成立,自屬格外重要。
