    Title: 車輛經代客停車在公有路停車位後遭竊得否求償之問題

    Abstract: 最高法院89年度台上字第1460號判決經簡化之案例事實為，甲駕駛其借自友人乙之系爭車輛，前往丙在某大樓第八層經營之三溫暖店消費。但丙店並無停車場，亦未租借場所代客人保管車輛，而僅在其大樓一樓門前公告提供代客停車服務；對此，當事人甲知情，而且乙在訴訟上亦不爭執。甲到達丙三溫暖店後，將系爭車輛交由丙之店員丁代客停車，而丁則交付號碼牌予甲，號碼牌背面印有「車輛停放路邊，若有刮傷、撞損或遺失汽車，概不負責」。不料，丁將甲之系爭車輛停放在公有路邊停車位之後，該車竟遭竊賊戊偷走。乙主張甲怠於對丙行使權利，故乙代位甲，依甲與丙間契約關係，對丙請求其依民法（下同）第607條負賠償責任，但本件之原審法院對乙之請求採否定見解，判決乙敗訴。本件經乙上訴後，最高法院認為乙之請求有理由，廢棄原審判決，發回高等法院。
