Abstract:	訴訟客體論之意義,乃指訴訟審理之客觀面對象,而與主體論者有所不同。但因在定義上,是否僅將訴訟標的等同訴訟客體,抑或亦可將訴訟標的物納入訴訟客體,可能成為文字分析學上不同見解。本文基於行文目的所在,乃將其限定在對於訴訟標的理論之討論。對於訴訟標的之討論,在國內累積文獻已多,學者多有不同見解。有採傾向與實體法連結者,有傾向自訴訟法角度理解者,有偏向原告處分權限解讀者,亦有兼顧兩造及法官之訴訟行為之觀點者,有持單一訴訟標的之標準者,亦有認為訴訟標的應有多元標準者,諸如此類,各具其理。
