Title:	為未滿15歲之未成年人投保死亡保險之立法辯證

Abstract:	民國（下同） 105年2月6日發生芮氏規模6.4之美濃地震，罹難者中，三分之一為未滿12歲之兒童。縱罹難兒童之父母曾為其投保，惟依保險法第107條規定，以未滿15歲之未成年人為被保險人訂立之人壽保險契約，其死亡給付於被保險人滿15歲之日起發生效力；被保險人滿15歲前死亡者，保險人得加計利息退還所繳保險費，或返還投資型保險專設帳簿之帳戶價值。此致以未滿15歲之罹難者為被保險人之保險契約受益人，無法請求保險金，僅得請求退還保費。有立委乃質疑，該條立法目的原為避免父母為兒童投保後，引發詐領保險金之「道德風險」案件，然此亦導致因遭遇天災死亡;未滿15歲之被保險人而無法支領死亡給付之憾事，並提案修法，針對天然災害所致未滿15歲之被保險人死亡，應給付死亡保險金，並建議溯及至105年1月生效1。
