    Abstract: 臺灣高等法院九十八年度保險上易字第三三號判決指出實支實付型醫療保險亦有複保險相關規定之適用,故要保人於投保時故意不通知保險契約即屬無效,並依要保人重複投保且請求理賠金額超逾實際支出醫療費用之事實,認要保人具不當得利意圖,該見解是否妥適?非無爭執空間。本文擬藉對此一判決之檢驗,就複保險規定於費用保險有否適用之命題為全面釐清。除對該判決之事實及理由為介紹及指陳本案爭點外,本文將就複保險適用範圍之學說與實務見解及複保險之構成要件詳為論述,並擬自複保險立法之基本原理損失填補原則出發,輔以比較法之考察及醫療保險之實務運作,就醫療費用保險是否適用複保險相關規定及若不適用是否必然增加道德危險為探討;其後並探究醫療費用保險於不適用複保險且有重複投保情形時各保險人應如何給付問題,冀對複保險規定於醫療費用保險適用相關爭議之解決釐清,有棉薄助益。
