Title:	台灣保險法關於違反告知或通知義務不退還保險費規定之檢討

Abstract:	保險費之性質係保險人承擔被保險人風險移轉之對價,故理論上倘保險契約效力解消,或保險契約溯及失效,保險人應不復有保險費請求權,且因契約解消或溯及失效,自契約效力消滅之時點起,保險人縱已收受保費,亦失去繼續保有保險費之法律上原因,否則即屬不當得利。然台灣保險法第二三條及二五條二條文明文規定保險人無庸返還保費者。此二條文縱屬保險人於保險契約關係解消或保險契約無效時保留保險費且不退費之「法定原因」,而不構成保險人之不當得利,然其法理基礎何在,誠啟人疑竇。台灣學說及實務見解縱咸認此等規定係懲罰惡意要保人或被保險人所必需,然對要保人或被保險人違反告知或通知義務為何有「懲罰」之必要,則未見詳盡說明。鑑於此,本文擬自私法契約原理、保險學與保險法基礎理論、立法論、經濟分析及比較法等諸面向重新釐清之此二條文之規範妥當性,並試就保險法關於保險費不退還制度之修正,略抒己見。
