    Abstract: 歐盟作為法律實驗室，在許多面向均有異於一國國內法或單純國際法之嶄新設計，歐盟國際私法之發展，即為著例。本文就歐盟國際私法上，最新關於支付命令規則之規定而為闡述，包括其法律定位與具體規範內容，以及其相關適用時可能產生之爭議。然而，在本規則之適用範圍;管轄權之決定;支付命令既判力之有無等關鍵議題上，其依舊有未盡之處。此等歐盟支付命令，當仍有修正改進之處；然其相關實施經驗，得為比較國際私法研究與各國實務所參考。
