Abstract:	商業法庭的成功必須綜合衆多因素而成,且各項因素間互相影響,交互作用。本文期透過對於美國紐約州、北卡羅萊納州,德拉瓦州等商業法庭之現狀與發展趨勢之介紹分析,從商業法庭的管轄權範圍設計、效率設計、品質設計,以及正當程序設計等面向,思考我國商業法庭建構時之管轄權範圍、審級制度、商業法庭法官來源與相關訓練、法院內其他專業人士之協助、ADR之採用、律師協力義務與職業道德之強化,以及電子化遞件與案件管理系統的採行等,逐步完善我國商業法庭之建構。
