Abstract:	日本最高裁判所與我國最高法院職權的不同。前者得針對具體案件就是否合乎憲法規定加以解釋(日本國憲法八一);反之,我國若有此類案件,必須符合司法院大法官案件審理法第五條所示之各項情形,才能聲請司法院大法官會議就是否合憲予以解釋,且大法官會議也不能就具體個案自為判決。
