Abstract:	前述案例,儘管問題看似僅有「如何進行救濟」一則,但欲解決如何進行救濟此一問題,必須先分析以下具有關聯性之法律爭點。詳言之,進行實例問題解答時,切忌只針對問題本身作答,必須具有整體法意識,對於題目中所有相關聯之重要法律爭點,均需逐一進行分析。就前述案例,必須加以回答之法律爭點如下:1.私立大學與教師間之法律關係為私法僱傭契約或行政契約?2.教評會之解聘、停聘或不續聘之決議性質為何?3.主管教育行政機關之核准性質為何?4.救濟途徑與方式?
