Abstract:	西方主要探讨1751年巴伐利亚地区所颁布《巴伐利亚刑法典》之背景与重要内容，希望籍此说明德国当代刑法如何开始以18世纪被建立。全文分为五个部分。第一部分说明1751年刑法典在德国刑法史上的重要意义并分析这部刑法典对于东亚继受德国刑法的社会法学研究的意义；第二部分说明这部法典订定的时代背景及其从19世纪以来被如何评价；第三部分说明这个法典的订定者克莱特迈尔在德国法制史上的意义；第四部分针对这个法典的实体法体例与内容加以介绍；第五部分比较这部法典与1532年卡洛林那法典的异同。
