Abstract:	本論文主要分析臺灣婚姻與家庭相關法律與法院實務在過去二十年來的變遷。臺灣的民法親屬編從一九九六年以來歷經十二次的修法,關鍵的修法主要關於婚姻制度(結婚的方式、夫妻財產制、夫妻離婚時未成年子女的保護教養權歸屬)、父母子女間關係及監護輔助制度的修改。另外,民法繼承編也從二七年開始歷經三次的修法,主要從繼承人無限繼承改為限定繼承。而一九九八年六月通過的家庭暴力防治法主要為防止家庭成員受到家庭其他成員的暴力行為。本文主要在比較一九九年代與二一年前後,臺灣地方法院審判實務呈現的婚姻與家庭面貌。希望藉此瞭解法律規範對於人民生活的影響。
