Abstract:	本文主要希望從規範的角度,針對清朝法制史研究進行省察與反思。本論文主要分為三大部分,第一部份嘗試跟讀者分享,筆者如何透過閱讀清朝法制相關研究成果,從規範角度思考清朝法制研究的當代意義。第二部分筆者嘗試參考西方學者有關法理學討論「法律是什麼?」的概念,嘗試分析清朝法規範的可能面貌為何。第三部分,筆者嘗試說明幾個可能分析清朝法規範的方法。由於筆者是一個法律研究者,在利用史料、分析清朝法規範的過程中,可能較為著重體系規範在實際運用中的情境。筆者希望在本文利用法規範的基礎理論,嘗試分析清朝不同的法規範及其本身的可能關聯性。筆者的目的在於呈現清朝法制的實際面貌及它在實際運作時,對於規範運用者的意義及影響。筆者希望透過研究方法的運用,減低在研究清朝法制史時,下意識存在以今非古或以古非今的主觀判斷。
