| Abstract: | 商標註冊是商標權人自我保護的一種方式，同時也維護消費者的權益，而在商標法商標註冊更是在於保護商標之區別力與交易秩序。當商標權人面臨侵害商標行為時得向法院提起訴訟，同樣地，非商標權人得依商標法第36條第1項不受他人商標權之效力所拘束作為抗辯事由。
於2016年，Cube Entertainment經紀公司與前韓國男團BEAST團員合約結束後，申請註冊六件BEAST商標，此舉讓原BEAST團員不得再以BEAST為團名進行活動。自2009年起至2016年BEAST團員使用BEAST商標長達七年，不論是電視節目、演唱會或週邊商品等皆有長期使用BEAST商標的足跡，縱使Cube Entertainment經紀公司申請註冊商標，原BEAST團員能否於原使用商品或服務範圍內繼續使用BEAST商標？
本文嘗試以此事件為出發點，首先介紹「不受他人商標權之效力所拘束」之概念，再藉由我國相關案例判決之商標侵權判斷基準，進而探討Highlight團體與經紀公司合約結束後，就團體團名商標使用爭議有無合理使用或善意先使用適用的可能性。
In the field of trademark law, trademark registration is a way to protect trademark owners and consumers. It also protects the distinctiveness of the trademark and the order of transactions. A trademark owner can sue an infringer for trademark infringement. On the other hand, the alleged trademark infringer can defense under Article 36, Paragraph 1 of the Trademark Act.
After the termination of the agency contract between Cube Entertainment and several original BEAST members, Cube Entertainment registered six BEAST-related marks in Taiwan in 2016. This causes these BEAST members not to be allowed to use the “BEAST” trademark as their group name. But the BEAST members started to use the “BEAST” mark in the TV program, concert or surrounding products between 2009 and 2016. Is it possible for the leaving members to continue to use the BEAST mark in identified goods and services? This thesis is intended to answer that question.
This thesis will introduce Article 36, Paragraph 1 of the Trademark Act and other trademark law concepts, first. Next, some relevant court decisions concerning trademark infringement in Taiwan will be reviewed to understand the current practice. Finally, this thesis will discuss whether it is legal for the Highlight group composed of those leaving BEAST members to use the BEAST mark or bona fide intent to use it in commerce after the completion of their agency contract with Cube Entertainment. |
