    Abstract: 本研究的目的是回顧我國自2000年至2019年3月底,有關AI人工智慧應用於法律實務之相關碩博士論文及期刊文獻之研究方向與趨勢。本文從臺灣碩博士論文知識加值系統及臺灣期刊論文索引系統檢索了38篇文章,並就關鍵字、文獻發表年份及其所應用之法律實務領域進行了分析與比較。本研究發現,以法院裁判實務及專利領域之相關應用與探討為最多,再者,本文也發現最被廣泛且經常使用的AI相關技術,為文字(件)探勘技術,包括中文斷詞、語意近似性、自然語言、詞頻等具體的應用。同時,本研究也發現,文字探勘一語在近年來已漸漸被人們以AI人工智慧或者機器學習的概念所涵括,尤其在2017年至2018年的文獻中更可發現許多文獻將文字探勘、人工智慧及機器學習並列,在在顯示這三者的關係在法律實務應用的將會愈來愈緊密,此一現象有助於了解過去國內有關AI應用在法律實務的重點及未來的可能走向。
    The purpose of this study is to review the transition and the trend of relevant research and the application of artificial intelligence on legal practice from 2000 to the end of March, 2019. This paper retrieved a total of 38 articles from Taiwan`s master`s thesis knowledge value-added system and the Taiwan journal article index system, and analyzed and compared the keywords, the years of publication and the legal practice fields they have applied. The current study found that most of the literature focuses on the application and discussion of the justice practice and patent. Moreover, we also found that “text mining” is the most widely adopted and frequently used related technology to AI, including Chinese segmentation and semantics, natural language, word frequency, etc. At the same time, the current study also found that the term “text mining” has gradually been covered by the concept of AI artificial intelligence or machine learning in the recent two years, which used to appear frequently in 2017 and 2018. Nowadays, more and more literature starts to mention “text mining” with artificial intelligence and machine learning in their studies, indicating that the relationship between these three will become more and more closely applied in legal practice. This phenomenon in the past helps us to understand the key points and the possible trend of AI applications on legal practice in the future.
