| 摘要: | 區塊鏈的概念自2008年提出後，隨著比特幣熱潮，在全球各界受到高度矚目，但我國相對其他國家投入的資源有限，因此，可善加運用專利資訊，以縮短研發時程以及減少研發經費，也是後來進入該產業的企業制定發展策略的重要參考依據。
基於一發明向一國家提出專利申請，該發明的說明書與申請專利範圍之內容需符合該國家的專利法及其專利審查基準之規定，本研究先探討對美國與歐洲在軟體與商業方法之專利法規與專利審查基準，建議申請區塊鏈技術相關專利時需補充具有解決某一技術問題的技術特徵，才能使該發明屬於專利適格標的，避免因不符合專利適格標的而無法取得專利權。接著，運用專利分析方法，以區塊鏈技術做為主軸，從美國、歐洲與世界專利資料庫中，檢索區塊鏈技術相關專利文獻，並透過專利量化分析掌握技術發展趨勢及專利佈局現況，且篩選出主要專利活動者-nChain控股有限公司、阿里巴巴集團控股有限公司以及IBM公司，進一步探討其在區塊鏈產業的願景/定位、發展時間、專利總申請量、專利佈局市場、專利申請與佈局策略，提供在區鏈產業不同研發定位的企業了解可能的競爭對手之研發、專利申請與佈局策略，參考並選擇適合企業本身的方式進行學習，也可了解區塊鏈技術相關專利熱門佈局的市場，縮短市場觀察期，或者尋求其他利基市場。
此外，基於台灣區塊鏈產業現況-政府立場與政策、產業概況與專利佈局之探討，提出台灣區塊鏈產業的發展建議-了解區塊鏈特性與自身需求、長期關注國際動態、人才招募、研發策略之擬訂與開源相對專利申請與佈局策略，期待避免發生類似「兩兆雙星」以及「四大慘業」的慘痛經驗，有助於屬於技術追趕者的台灣企業制定其研發、專利申請與佈局策略。
The concept of blockchain was proposed in 2008. With the bitcoin boom, the blockchain has been highly regarded around the world. However, Taiwan has limited resources to invest in blockchain development relative to other countries. Therefore, patent information can be used to shorten R&D time and reduce R&D funding and is also an essential reference for companies that have entered the industry to formulate their development strategies.
Since patents are territorial rights, the claim and specification of the patent application are subject to the patent law and examination guidelines of the country where the patent application is filed. In this research, the patents on software and commercial methods in the United States and Europe are discussed first. According to the patent regulations and examination guidelines, it is recommended that when the blockchain technology-related patents are filed, it is needed to supply the technical characteristics of solving a certain technical problem to make the invention be a patentable subject matter. Then, the method of patent analysis is used, blockchain technology is the main axis of research. The patent documents related to blockchain technology are retrieved from the US, Europe, and the PCT patent database, and patent quantitative analysis is performed on the patent documents related to blockchain technology to grasp the development trend and the patent portfolios of the technology. The main patent applicants - nChain Holdings Limited, Alibaba Group Holdings Limited, and IBM are selected to explore their vision / positioning in the blockchain industry, R&D time, patent application quantities, patent markets, and strategies for patent application and portfolios, to provide companies in each R&D positioning of the blockchain industry to understand. From that, each company can learn and choose the method that suits itself, and understand the markets for applying the blockchain technology-related patent applications to shorten the market observation period or seek other niche markets.
In addition, based on the current situation of Taiwan`s blockchain industry-the standpoints and policies of the government, overview for the industry and patent portfolios, the suggestions for the development of Taiwan`s blockchain industry are proposed – understand the characteristics of the blockchain and the needs of the enterprise itself, long-term attention to international development, recruitment, develop the research and development strategy, and open source vs. patent application and portfolio strategy, to avoid the failure similar to “Two Trillion and Twin Star Development Program” and the LCD, DRAM, LED and Solar (3D1S) Industries, helping Taiwanese companies belonging to technology pursuers to formulate their R&D, patent application and portfolio strategies. |
