    Abstract: 透過比較法研究，本地法學或司法工作者，從他地的正面或負面的經驗，得到學習的榜樣，或得到應該避免的前車之鑑。本文以「已退休公務員退休金減少」與「禁止溯及」為例，說明「本地所需解決的問題為何」並非不證自明，政治部門（包括行政部門與立法部門）可能透過「形塑本地所需解決的問題」，擴大或縮小「他地經驗」的範圍，進而影響「本地法律問題」的解決。對於我國「已退休公務員退休金減少」是否違反「禁止溯及」之問題，本文介紹美國聯邦憲法第1條第10項「契約條款」（the Contracts Clause）內容與案例，並思索對於我國法的意義。本文企盼幫助讀者感受比較法研究可能涉及的議題設定問題。
