Abstract:	使用公務加油卡補充公務車的油料是現今公務體系中極常使用的加油方式。理論上使用公務加油卡補充的油料只能置於公務車中，然而現實上並不容易控管卡片與車牌番號的一致性，故實務上出現一定公務員貪小便宜，使用公務加油卡到加油站加油簽帳，但將購買的油料加到自己或第三人所有的私用車輛，然後再設法以內容不實或無權制作的單據向公務機關的會計單位申請核銷。問題在於，應該如何對類似行為進行合理的刑法評價？許恒達老師於本判決評釋中，首先點出此種案例具有反覆實行而金額尚非過鉅之特性，但因行為人是公務員取得屬於公家財產之財產利益，故有貪污治罪條例之適用，往往造成情輕法重之困擾。了解問題來由後，文章之後續討論將行為階段具體化，並分別檢討不同罪名的成立可能性，最後再處理各罪競合的問題，完整分析本案應如何論罪。
