    摘要: 隨著經濟發展、人均可支配收入提高，化妝品不再只是奢侈品，而是人們日常生活用品之一部分，並因著全球化及國際貿易之發展，各國人民有更多機會購買到其他國家之化妝品，各國化妝品產業隨之蓬勃發展。

    近十年來，中國化妝品產業之市場規模不斷地增長，根據Euromonitor所調查之數據，中國消費額就全球化妝品市場占比率自2018年開始已超越美國，成為全球最大的化妝品市場。然而中國化妝品目前之管理架構及法規係源於1989年間訂定之《化妝品衛生監督條例》（Regulations Concerning the Hygiene Supervision over Cosmetics）及其他相關規定，對於這個不斷更新進步迅速之產業，這個已經使用了30年的規範體系似乎不足以因應現今化妝品產業之快速發展，加上中國之化妝品規範沒有一個系統性的架構，多個機構之規定可能重複甚至解釋不一，導致法規適用不易。中國當局未忽視其化妝品市場之規模和增長，自2018年開始，對化妝品主管機關整合及規範進行系統性大調整。

    有關化妝品法規，常涉及技術性貿易障礙之爭議，中國自加入WTO以來，被WTO會員提出多次有關化妝品規範之技術性貿易障礙關切，而針對近兩年中國化妝品規範之調整，亦衍生出新的關切案。基於中國為目前國際上最大之化妝品市場，且其規範可能對其他WTO會員之化妝品進口造成影響，是以本文將從中國化妝品法規有關之TBT特定貿易關切切入，針對中國現行化妝品管理法規以及正在修訂之重要草案進行分析，探討各該法規或草案與WTO技術性貿易障礙協定間之適法性，並做出初步之評估。
    With the growth of economy and increase of per capita disposable income, cosmetics are no longer just luxury goods, but a part of people`s daily necessities. Due to the development of globalization and international trade, people have more opportunities to buy cosmetics from other countries through international trade.

    In the past ten years, the market size of China`s cosmetics industry has been continuously increasing. According to Euromonitor’s data, China ’s consumption has surpassed the United States in terms of the global cosmetics market share since 2018, and becomes the largest cosmetics market in the world. However, the current rules and regulatory structure of cosmetics in China are derived from the Regulations Concerning the Hygiene Supervision over Cosmetics and other related regulations established in 1989. For this industry that is constantly updated and progressed, the China cosmetics regulation system, which has been in use for 30 years, seems to be insufficient to cope with the rapid developments of the cosmetics industry today. In addition, China`s cosmetic regulations do not have a systematic structure, and the regulations of multiple agencies may be repeated or even interpreted differently, resulting in difficult application of regulations. However, the Chinese authorities have not neglected the scale and growth of their cosmetics market. Since 2018, they have systematically adjusted and integrate its regulation and authorities.

    Cosmetics regulations often involve disputes over technical barriers to trade. Since China`s accession to the WTO, other WTO members have raised various specific trade concerns about technical barriers to trade in cosmetics rules and standards, and China’s regulatory reforms of cosmetics in the past two years have also generated new concerns about trade. Given that China’s cosmetics market is currently the largest in the world, and its regulations may affect the import of cosmetics by other WTO members, this thesis will summarize TBT specific trade concerns related to China`s cosmetics regulations, and analyze China`s current regulatory reforms on cosmetics and revised rules introduced in the draft regulations. Finally, this thesis will examine the legality of selected rules with the WTO TBT Agreement, and conclude with policy recommendations.
