摘要:	加密貨幣和區塊鏈技術近來受各界重視，目前在金融領域主要應用是作為支付工具與投資商品。以比特幣為首的加密貨幣區塊鏈是非認許制公有鏈，亦稱為「分散式帳本技術」，主要特色包括：交易去中心化、紀錄無法篡改和永久記錄、交易即清算。然而隨著加密貨幣區塊鏈蓬勃發展同時衍生許多問題，使各國政府紛紛採取管制措施，管制程度可分為「開放」、「禁止」、「審慎管理」，管制理由包括：維護中央銀行貨幣主權、金融穩定與投資人保護、防止資本外逃、打擊犯罪行為以及維護傳統宗教與文化等。固然國家有權力在其境內對加密貨幣區塊鏈進行管制以達成公共政策目標，然而在WTO 規範下，會員若對加密貨幣區塊鏈有關政策措施作出貿易承諾，則實施對加密貨幣區塊鏈具有貿易限制性之措施可能違背對其他WTO會員開放承諾之義務，進而演變成貿易爭端之虞。然而WTO亦允許會員基於特定公共政策目的正當化其貿易限制措施，因此，此等政策措施之WTO適法性容有爭辯之餘地。以中國為例，其原先為世界最主要的加密貨幣交易市場，但在實施一系列管制措施後，使以比特幣為首之加密貨幣交易量從全球首位占比百分之九十下降至不足百分之一，具有巨大的貿易限制效果，未來十分可能演變成為他國控訴中國之貿易爭端下的系爭措施，因此，本文將以中國加密貨幣管制措施為中心，分析其於WTO的適法性。本文分析後，初步認為加密貨幣區塊鏈應被分類為金融服務下的支付服務，應受GATS規範，中國因對支付服務已作出開放承諾，其部分管制措施有違反GATS之疑慮，但亦很可能以一般例外和審慎例外正當化其管制措施。最後本文提出促進加密貨幣區塊鏈貿易自由化之建議，希冀在深化加密貨幣區塊鏈貿易自由化的同時，能與各國管制空間取得平衡，建構和諧國際治理架構，創造政府、服務提供者以及消費者共贏的局面。 The cryptocurrency and blockchain technology are more and more important in many fields in recent years. Mostly, in finance, the cryptocurrency is used as payment tool and investment asset. Bitcoin, on behalf of the cryptocurrency blockchain, is permissionless public blockchain, as known as “distributed ledger technology”, which features transactions decentralization, immutability and synchronization. However, it brings on many problems among countries along with the ongoing development of the cryptocurrency blockchain, so governments begin to take measures to regulate it. Generally, the degree of regulation has three levels: “openness”, “prohibition” and “prudential regulation” and the regulation purposes includes: maintaining monetary sovereignty, financial stability and investor protection, prevent capital outflow, fighting crime and reserving traditional religion and culture. Despite the fact that a member definitely has the power to regulate the cryptocurrency blockchain in its territory in order to achieve public policy goals, under WTO it is possible to develop into trade disputes that the member imposes trade-restricted measures on the cryptocurrency blockchain which might violate the commitment toward other members, if the member have made commitment of the cryptocurrency blockchain. Besides, WTO allows members to justify their trade-restricted measures based on certain policy goals. For example, China originally was the major cryptocurrency exchange market in the world, but after a series of regulatory measures, the exchange volume of cryptocurrency (especially Bitcoin) dropped from world leading 95% down to less than 1% with huge trade-restricted effects. In the future, these measures are possible to develop into trade disputes that other countries complain to China. Therefore, this article will especially focus on the cryptocurrency regulatory measures of China and further conduct the legal analysis under WTO agreements. After analysis, we may arrive at the conclusion that the cryptocurrency blockchain should be classified as payment service of financial service under GATS. Because China has made commitment on payment service, part of its regulatory measures are likely to violate GATS, while are possible to be justified under general exception and prudential exception. In the end, this article provides some suggestions to prompt the trade liberalization of the cryptocurrency blockchain, hoping to strike a balance between the regulatory space of countries and free trade and then construct a coherent international governance framework which achieves a triple win situation of governments, service providers and consumers.
