Abstract:	銀行法第29條之1構成「吸收存款」行為之要件中，關於「向多數人或不特定人收受款項或吸收資金」及「約定或給付與本金顯不相當之紅利、利息、股息或其他報酬」，仍屬不確定法律概念，倘不予嚴格解釋，恐將牴觸罪刑法定主義。爰此，本文試從銀行法第29條之1構成要件分析，輔以鄰近之香港與新加坡銀行法令之比較法考察，試釐清違法吸金罪之打擊範圍。
