Abstract:	2018年4月，因醫師公會全國聯合會與11家產險公司簽訂「醫師業務責任保險合作推廣備忘錄」，而使醫師專業責任保險是否應採強制投保的議論再起。本文試從強制補償保險與強制責任保險之區別入手，檢驗主張醫師強制責任保險者論證之妥適性。 On April 2018, the Taiwan Medical Association signed with 11 Property and Casualty Insurance Companies the “Memorandum on the Cooperation in Promoting Medical Liability Insurance” which once again incur the advocates of making the medical liability insurance compulsory. This paper will examine the appropriateness of reasons supporting compulsory liability insurance by emphasizing on the fundamental differences between compulsory compensation insurance and compulsory liability insurance.
