| Abstract: | 人體組織蘊含人類基因及基因組資訊，隨著生物技術和生命科學的迅猛發展，各國生物醫學產業發展的競爭日趨激烈，基因科技的迅速發展雖然造福人類，也對人性尊嚴、生命健康權、身體權、隱私權等憲法權利帶來巨大挑戰。近年來國際上已開發國家的生物剽竊行為、宣稱擁有基因改良之智慧財產權；與開發中國家擁有原始遺傳基因流出使用、卻無法享有基因改良成果，顯有國力弱肉強食的現實，如何折衷進行立法規範並確立保護人類遺傳資源核心理念已成為法學的一個重要課題。國際上對於人類遺傳資源看法及執行內容的深度及廣度有無差異，值得進一步研究及探討。
本研究係以中國《人類遺傳資源管理條例》為例，以物權、人權、國家主權角度切入探討其人類遺傳資源保護規定內容、制定沿革背景及比較兩岸之間在人類遺傳基因資源保護、個人隱私權的差異、法律位階面向及優劣勢關係。
Human tissue contains human genes and genomic information. With the rapid development of biotechnology and life sciences, competition in the development of biomedical industries in various countries is becoming increasingly fierce. Although the rapid development of genetic technology has benefited human beings, it has also affected human dignity, the right to life and health, and the right to body. Constitutional rights, such as the right to privacy, pose great challenges. In recent years, international countries have developed plagiarism and claimed intellectual property rights in genetic improvement; they have the original genetic gene outflow and use in developing countries, but they cannot enjoy the results of genetic improvement, which shows the reality of national strength, weak meat and strong food. How to compromise legislative norms? And establishing the core idea of protecting human genetic resources has become an important subject in law. Are there any differences in the depth and breadth of international views and implementation of human genetic resources, and it is worth further research and discussion.
This study takes China ’s “Regulations on the Management of Human Genetic Resources” as an example, to explore the content of its human genetic resources protection provisions, formulate the background and compare the protection of human genetic resources between the two sides of the strait, individual Differences in privacy, legal ranks, and advantages and disadvantages. |
