Title:	循環經濟法制之研究－以廢棄物性質之終止為中心 A Study on the Legal System of Circular Economy – Focus on the End-Of-Waste Status

Abstract:	歐盟2008 年廢棄物框架指令最特別之處，在於建立廢棄物金字塔架構，區分廢棄物及副產品，以及廢棄物性質終止之制度設計，相關規範對於循環經濟而言皆為重要且嶄新的法制。為終止廢棄物性質，以使其能夠再進入生產體系，最重要者為須針對相關物質或物體對於環境及健康可能造成的影響進行評估，並且須就內含的有害物質之閥值進行一定規範。德國2012 年廢止之前的循環經濟及廢棄物管理法，另公布循環經濟法，在原有的循環經濟法制體系下，更進一步於第5 條規定廢棄物性質之終止。本條規定不僅與歐盟指令相關規定之精神相符，更授權聯邦政府訂定法規命令，針對終止廢棄物性質應進行之環境及健康評估與有害物質閥值進行規範。相關法制為循環經濟最新的立法規範，具有高度的參考價值。反觀我國，法制仍停留在廢棄物清除處理及資源再利用之觀念，即使是行政院或立法委員提出之修法草案，仍可看出對於最新循環經濟之立法趨勢缺乏認識。循環經濟現今已然成為最重要的經濟發展模式，並可同時兼顧資源保育及環境保護，然而因我國在法制上對於循環經濟概念及最新的法制設計仍相當陌生，透過對於歐盟及德國關於廢棄物性質終止法制的研究及觀察，相信對於未來循環經濟法制建立與產業發展應有一定助益，對於環境保護法制之完備亦具有相當的重要性。
