    Abstract: 我國各級政府直接或間接投資之事業，爾來在實務上有增多之趨勢，絲毫不受全球 民營化風潮之影響。新設之桃園國際機場公司、臺灣港務股份有限公司、桃園航空城股 份有限公司、桃園縣大眾捷運股份有限公司及臺中快捷巴士股份有限公司等，皆屬適 例。至於含有官股，但不超過百分之五十之公股事業，亦普遍存在。例如臺北金融大樓 （臺北101）股份有限公司及臺灣高鐵股份有限公司。 對於此等「公股事業」組織、經營、財務及人事之行政及國會監督，除對於國營事 業訂有國營事業管理法為專法規範外，對其餘地方公營事業及政府少數持股之公股事 業，皆無統一之監督規範，毋寧分散於各法令中，且多屬行政規則性質。有鑑於政府投 資事業具有公股成分，事業得否僅以營利為唯一目的，學說上屢有爭議。行政及立法機 關對此等事業得否以及應為何範圍及密度之監督，為本計畫之主要問題意識。本研究擬 彙整我國現行相關法規，以學理為基礎，進行分析檢討，並提出可行之革新建議。「公 股事業法」之體系建構，為主要之研究目的。 本計畫執行期程為三年，逐年就「『公股事業法』之概念及體系建構」、「公營事業 監督法制之檢討及興革建議」及「政府投資民營事業之法律規制」三子題進行研究。預 期產出之研究成果，為每年至少完成1 至2 篇中、長篇幅之學術專文的寫作。最終之總 成果，期待能集結成冊，出版以「公股事業監督法制」為主題之專題式學術論文集。若 此，將是我國第一本以公法學觀點探討公股事業監督法制之個人學術論文集。
