Title:	論數位經濟時代的網路經銷限制

Abstract:	電子商務為數位經濟時代的具體表徵，網路交易資訊即時而透明的特性，對消費者行為，以及製造商（供應商）與經銷商的經營策略造成實質影響，也對現行競爭法如何適用在網路經銷的限制形成挑戰。本文是以歐盟規範管制與執行實務為借鏡，藉由幾個指標性案例的論述，說明線上經銷非價格限制在目前反托拉斯法執行上的爭點，其要項包括全面禁止經銷商網路銷售、或雖非全面禁止但要求同時經營實體店面、禁止在第三人平台使用製造商（供應商）商標或利用搜尋引擎，以及完全禁止使用第三人平台銷售等。本文同時摘述歐盟於二○一七年始完成的電子商務產業調查報告內容，觸及線上平台（市集）使用及地理區塊劃分等主要競爭法疑慮。公平交易委員會目前就網路經銷限制相關議題，尚無具體的個案可資研究，公平交易法如何適用在當前蓬勃發展的線上交易，猶待積極補充，建議公平交易委員會迅速調整執行方向與目標，以健全數位經濟時代的市場競爭環境。
