    Abstract: 市場界定是電信產業管理及法制規劃的根本前提，而電信產業技術創新與匯流的特性，加重了電信市場界定的困難與複雜。當電信市場由管制朝向自由化邁進之後，競爭法與競爭機關應在電信市場發揮其功能，在適當管制、促進競爭的原則下，發展出符合電信市場特性的法令規範。歐盟「2002電信規範架構」在內涵上導入競爭法原理原則以界定電信市場：管制方面，以累積適用「高而持續的市場進入障礙」、「欠缺有效競爭的動態趨勢」、「競爭法的有效性」三項標準，以選擇適於實施「事前」管制的市場；在促進競爭方面，則是在「相關市場界定公告」的基礎上，同時考量創新與匯流的產業特性以劃定電信市場範圍。「網路電話」（VoIP）涉及的市場界定議題，具體呈現創新與匯流如何地影響市場界定的特殊性。歐盟電信市場無論採「事前」管制或回歸自由競爭，競爭法與競爭機關在電信業領域，皆承擔重要的管理任務與功能。我國對電信市場界定的議題著力不深，相關主管機關通傳會與公平會職權劃分標準不當，僅以粗略的「事前規範」與「事後規範」示之，亦未考量創新與匯流對電信市場界定的影響。參酌歐盟現行電信規範體系的理念與作法，通傳會與公平會應積極分工合作，調整現行運作模式與法規，俾利電信產業的未來發展。
    Market definition is an essential element for the purpose of proper regulation in the electronic communications sector. Technological innovation and the convergence in the telecommunications, media and information technology sectors, which mean all transmission networks and services should be covered by a single regulatory framework, make the task of market definition more complicated due to the more complex and dynamic markets. The new EU “2002 Regulatory Framework”, being integrated with the competition law principles, refined the methods for selecting markets and designated the European Commission, periodically and prospectively, to define and to make the market recommendations susceptible to ex-ante regulation. The European Commission was also required to publish guidelines, in accordance with the principles of competition law as well, on how to assess the market power owned by an operator in order to identify if there are any one or two enterprises with the significant market power (SMP) on the market. The case of Voice over Internet Protocol (VoIP) especially shows how emerging services impose the difficulties on the task of market definition for the regulators. The EU regulatory system and practices in the electronic communications sector demonstrate itself a good model and have of great value for reference to our regulatory authorities in the related fields.
