    摘要: 台灣原住民族自治運動自1987年發起《台灣原住民族權利宣言》後，將「自決權」視為原住民族的「既有權」，開展了一連串的人權運動。本研究將針對這三十年來運動歷程中參與者的論述、組織、行動與社會過程，聚焦在原基法21條諮商同意權通過之後，法律在其中扮演的角色。運動者如何運用法律？是否有其策略或開展出特有關聯？法律是否得以促成社會變遷？最後產生何種影響？原住民族自治的法律動員，指的是將原住民族主體與自我決定的需求與慾望，轉譯為權利主張，從中發展的社會論述與實踐，具有改變社會意識的力量。然而，社會意識的改變過程，絕非純粹線性發展、漸次進步的過程，法律動員要改變社會意識或民眾法意識，必然牽涉到整體的人權論述實踐、政治政策辯論、文化衝突碰撞等層面。原住民族自治運動就是要對抗文化衝突與文化減損的現實，但也必須注意到人權運動的論述、組織、宣傳等法律動員，如何對原住民族文化產生影響。研究人權實踐的學者也已經開始注意到，運動者彼此之間的溝通、與同盟者或對立者的互動、與政治人物的交往等，這些都牽涉到政治經濟、規範信念、權力階層的議題，都會影響到人權的法律動員。然而，上述研究雖然將焦點放在人權實踐社會過程，卻未聚焦於社群內外「關係」的影響，也沒有挖掘在原住民族自治議題上複雜多變的「認同」議題，包括情感上的個人認同與族群認同。本研究將以這兩分面為主，研究原住民族自治運動的法律動員，一方面理論化人權實踐的集體行動與社會過程，另一方面將情感與人際關係納入分析的視角。這方面的文獻申請人已有關於法意識情感與認同議題的相關著作，當有助於本研究的開展、整合與思辨。本研究第一年將整理文獻，同時進行原住民族自治運動者與其部落住民的訪談與個案故事撰寫。第二年將撰寫關於原住民族自治的法律動員文章。第三年將撰寫四個原住民族自治個案研究的文章或專書。
    This project aims to map the development of indigenous self-government legal mobilization after the enactment of consult-consent right in 2005. How do the activists make use of the law? What are their strategies? Does law enhance the social transformation for justice? What are the social effects of law in land use, racial identity, and cultural change? I will use the academic concepts of legal consciousness interacted with emotion and identity to study on the cultural analysis of the practice of human rights. This project may help disclose the relationship between law, racial conflict, and cultural development, as well as the concept of emotion, identity, and legal modernity in the area of legal mobilization and legal consciousness.
