    Abstract: 本計劃原本申請三年期,但計畫僅通過一年期。因此,原本三個案 例研究僅能執行一個,僅就鄰里衝突的部分做為案例,以探索自我 認同與關係法意識的議題。目前計畫執行完畢,完成一篇英文文章 ,已投稿SSCI期刊審查中。 法意識文獻雖強調法意識乃在關係互動中形成,但並未詳論形成過 程。本研究就一個鄰里衝突引發的警察介入事件,分析人們法意識 在關係互動裡的動態發展。本文發現,人們法意識的關鍵與其說是 自我認同,不如說是在關係互動中的認同情感。人們為了求得較佳 的道德位置,會運用法律強大的象徵意義,讓自我呈現與表達得以 回應認同情感的劃界需求。因此,法律與社會關係乃是一個互相建 構的過程,法律支撐人際間的認同情感,而社會關係也反過來建構 了法律的社會作用。透過法意識的研究,得以深入理解法律在當代 社會所扮演的角色。
    Literature on legal consciousness has identified relational nature as an important trend, but has rarely elaborated on the process as evoked by interpersonal interactions. This article proposes the co-constitutive model of legal consciousness in which identification maps boundaries, elements, and stages for the moral foundation in getting a better position or more interests in an interpersonal conflict. By discussing some cases on neighborhood disputes around Taipei, concerning security issues, it explores the relational self manipulating expressiveness to earn sympathy or bring shame in normative complexity, that dominates the formation of legal consciousness. This article argues that it is the emotion culture of fabricating personhood that makes use of law to dress up the relationship in pursuit of mutual identification. Foregrounding the process of co-constitutive nature of legal consciousness offers scholars a framework to better understand and operationalize the dynamic nature of human relationships to law.
