Abstract:	現行刑事訴訟法第260條賦予檢察官之不起訴處分具有相當之確定力。但此一規定是否妥當，向來即有爭議。本文從德 ; 美以及國際人權公約等，介紹相關制度以及規定，期能釐清諸多訴訟原理及其解釋。另外並從人權保障 ; 偵查之結構 ; 檢察官認定事實之程序 ; 有效犯罪訴追等要求，以及本規定對實務之影響等，提出本文之看法，並草擬修法方向，以供參考。
