Title:	從SARS到COVID-19：司法院釋字第690號解釋架構下之傳染病防治法制與基本權限制

Abstract:	我國在 SARS 流行期間，因為傳染病防治法制不足而引發過度限制人身自由之爭議，2020 年為防治爆發全球大流行的 COVID-19 於我國之傳染，政府適用經修訂之傳染病防治法與緊急通過之嚴重特殊傳染性肺炎防治及紓困振興特別條例，作成各種曾經採取或首次使用之限制人身自由之強制措施，仍因為若干措施之授權法律有不明確之疑慮，又再度引發議論。若以司法院釋字第 690 號解釋所建立，對於非刑罰性質，為了疫情防治需求，由具醫療及公共衛生專業之主管機關，採取保護重大公益之人身自由剝奪措施合憲體系，則目前各種限制人身自由之措施，均有被論證為合憲之可能。然釋字第 690 號解釋所建立之合憲論證，是否確實為民主法治國傳染病防治之應有方向，仍值深思。
