    Abstract: 工業4.0與勞動4.0,帶來新興的技術方式與生產組織的變化,由其所催生之數位平台經濟模式的出現與發展,更使傳統侷限於企業內、勞動契約關係明確之勞動法觀察方式,與其熟悉的概念:勞工、雇主、勞動指示權、從屬性等,面臨嚴厲的挑戰。本研究在分析勞動4.0之面貌後,將分析數位平台經濟模式所帶來之勞動形式的變化,並指出其套用現行勞動法學產生之障礙與問題,最後提出法釋義學與法政策論之建議,包括勞工概念之重組、類似勞工體系之建立、勞務提供者普遍勞動保護之引入等 
    The so-called Industry 4.0 and Labor 4.0, bring new changes in technology and productive organization. The emergence and development of the digital platform economic model that was spawned by them, make the traditional observative method, confined to the enterprise and its clear link to the labor contract within the system of the labor law, including its concept such as employee, employer, labor instructions and not the least the nature of dependence, to face several challenges. After analyzing the face of Labor 4.0, this study will analyze the changes in the labor form brought about by the digital platform economic model, and points out the obstacles and problems caused by applying the current labor law. At last, this study will put forward the suggestions of legal interpretation and the legal policy, including the reorganization of the concept of dependent worker, the establishment of the system for the so-called similar worker and the introduction of general labor protection for service providers.
