    Abstract: 本文針對2019年通過（尚未生效）的「海牙判決公約」進行相關談判與起草歷史、條文主要規範與疑義，以及相關之對於外國裁判承認執行之基礎與例外不承認事由等，進行全方位的評析。此外，針對既有民事訴訟法第402條關於外國裁判之承認執行要件，本文亦為簡要之評介，並從2019海牙判決公約之視角，針對相關規定日後之修正可能提供一定之建議。
