| Abstract: | 本文的目的在於探討基本收入成為我國社會安全制度一環時，所可能面臨到的法律問題。此包含兩大區塊：其一，基本收入的合憲性。其二，基本收入的制度定位、細部設計與既有制度間的關係。
為了回答上述的問題，本文一方面從基本收入的定義著手，探詢其歷史發展、理論基礎、預期效益跟反對意見，並輔以2017年在芬蘭進行的社會實驗，試圖理解基本收入的制度內涵。另一方面，以我國憲法上的社會國原則為依據，重行檢視我國社會安全制度的架構與內容，並分析其所面臨的挑戰與困境，從而得出基本收入對於我國而言具有何等的意義。
在假設基本收入可能成為我國社會安全制度的前提下，本文嘗試從我國憲法中找尋基本收入的憲法基礎，並反面排除了違憲的質疑，包含：自我負責原則的侵蝕、過度照顧禁止原則的違反與國家財政的衡平等，從而架構出基本收入的合憲框架。接著，便著手設計屬於我國的基本收入制度，從制度定性開始，依序規劃給付對象、給付數額等，並與既有的制度間相互調和，最終完成我國社會安全制度的再建構。
The purpose of the thesis is to discuss legal problems which may arise when Basic Income becomes part of the social security system in Taiwan. The issues can be divided into two major parts: one is the constitutionality of Basic Income and the other is its positioning in the system, detail design and relationships with other existing institutions.
To deal with the aforementioned issues, on one hand, the thesis will start with the definition of Basic Income and explore its historical development, theoretical effects and opposing views while introduce social experiment conducted in 2017 in Finland, fully presenting Basic Income’s nature. On the other hand, based on welfare state principle, review of the current social security system’s structure and contents in Taiwan and analysis of challenges and dilemmas which the system is facing with would be both conducted in order to discover the meaning of Basic Income to Taiwanese society.
On the premise that Basic Income may become part of the social security system in Taiwan, legal basis supporting the idea would be discovered in the constitution and the doubt of unconstitutionality including erosion of self-responsibility, violation of the principle forbidding over-provision of resources and stability of state finance would also be dispelled with robust reasons, which together form a constitutional framework for Basic Income. Moreover, the thesis would attempt to design a Basic Income System implementing in Taiwan, beginning with the institution’s position, deciding the recipient and the amount of Basic Income, and adjusting the existing policies. Finally, the reconstruction of social security system in Taiwan would be achieved. |
