Abstract:	"本文乃將產品責任自消保法(第七條至第十條之一)暨施行細則(第四條至第八條),公布施行至今,以及民法重要相關規定(第一九一條之一、第二七七條、第二二七條之一)修法動態與背景,加以說明。其次,產品責任(主要以消保法第七條至第十條之一及民法第一九一條之一為主)所涉及之主要問題:責任性質、產品瑕疵(產品欠缺安全性)、責任主體、責任客體、保護法益、請求權人、損害賠償之範圍、舉證責任分配、產品責任法與民法及其他特別法之適用關係,分別討論,並輔以歐體產品責任準則與德國產品責任法之發展概況分析比較。"
