    Abstract: 甲塑膠加工廠生產塑膠袋有年,為特定國外訂單向乙採購高密度H.D.P.E.塑膠粒一批,於契約中約定乙應於八十六年二月二十八日交貨。乙之司機丙於該日將甲所需的塑膠粒在該日載往甲處,甲廠卻因政府突然宣布該日改為國定假日,大門深鎖,丙不得其門而入,也無人值班受領。丙在電話中向乙請示,乙乃令丙改將貨物改送至離甲廠不遠且曾訂貨的丁廠並經受領。此事為甲所知,而次日該原料價格大跌,甲以該批給付因可歸責於乙之事由致給付不能,請求解除契約,乙堅持另行交貨,試析其法律關係﹖又若丙將該批塑膠粒運回乙處,結果中途因天雨路滑,車子因丙之輕過失(略有超速)翻落溪中,貨物全部流失,誰應負責?
