    Title: P2P的挑戰與未來︰從Grokster案看P2P立法的爭議

    Abstract: 當第一個利用檔案分享P2P技術的軟體Napster在1998年於網路世界出現後,立刻吸引了網路使用者的注意,不但開創了網路利用的新型態,引發音樂世界的的巨變,更衍生出一連串與數位內容有關的法律挑戰。雖然Napster開風氣之先,但是卻無法擺脫侵害著作權的疑義,隨著美國錄音工業協會(Recording Industry Association of America, RIAA)於1999年12月6日向北區加州聯邦地方法院對Napster正式提出侵害著作權的控訴,在法院核准RIAA的暫時禁制令(injunction)後,Napster被迫在2001年7月3日清晨關閉其所有歌曲交換下載的功能,使得Napster暫時走入歷史。Napster的停止提供服務,雖然讓唱片業者贏得第一場與P2P業者的遭遇戰,但是並不意味者唱片業者就贏得這場戰爭,事實上,從後續的發展顯示,RIAA戰勝Napster但是卻無法阻止P2P技術所帶來的挑戰,也無法停止P2P對數位內容產業所造成的威脅。
