    Abstract: 本文之主要目的乃是側重於基本法理的闡述，針對專利權侵害所生不當得利之成立與利益返還，結合專利權本身之特性，兼顧專利法之法理，加以理論性之釐清與闡述。期待本文之完成有益於未來專利權侵害下不當得利相關規範之解釋適用。另外，本文針對專利權侵害之不當得利，探討是否適用誠實信用原則而有權利失效之可能？最後，關於專利權侵害之不當得利的利益返還，本文認為專利貢獻度之法理，仍應適用，方能正確反映專利權價值，確實貫徹不當得利調節不正損益變動之衡平目的。
