Title:	電子書之散布與散布權之權利耗盡

Abstract:	甲於網路上以會員制經營電子書店，接受會員贈與二手電子書，並出售受贈之電子書予會員，凡曾贈與電子書之會員，於購書時享有價格之折扣。該電子書店允許會員間二手電子書之互易或買賣。一日，會員乙贈與其購得之合法授權製作的電子書E1予甲，甲囑乙讓與E1所有權時，應移除原存於載體之E1重製物，乙並確實移除重製物。甲又將E1轉賣給會員丙，於讓與所有權時，亦移除E1重製物。丁為電子書E1所含著作之著作財產權人，見甲未經其同意，讓與E1之所有權予丙，主張散布權之侵害，而甲以權利耗盡原則抗辯之，試問甲之抗辯是否有理由？
