Abstract:	本文從國際貨物買賣契約法公約（CISG）出發，對其主要內容，包括適用範圍、契約之要素、成立與效力，以及根本性違約、預期違約等債務不履行問題進行評述。此外，就因各種天災人禍所引發之不可抗力而得作為債務不履行時責任免除之例外條款，本文就CISG與其他國際商事規範，包括UNIDROIT國際商事契約通則與國際商會ICC之相關不可抗力條款等，亦進行詳細的闡述。最後，本文以2021年3月底罕見的長賜輪於蘇伊士運河擱淺事件為例，分析前述不可抗力條款，於此事件相關當事人間之適用可能性。
