Abstract:	本案為被上訴人向上訴人等請求強制認領之訴，由於生父已死亡，故依照民法第一○六七條第二項之規定，得向生父之繼承人為之。又提起確認親子關係存在之訴，須以法律上之全體繼承人為之。故本案為一確認繼承人之中間裁定。
