    Abstract: 病人自主權利法與意定監護制度於 2019 年同時施行，意定監護制度使得本人得為未來失去表意能力之情形，就財產與身上照護事務預作安排，其中自包括有關醫療決定之事項，特別在生命最後階段中，得否拒絕使用延命措施，享有善終的權利，已於病人自主權利法中有明文規定。又依該法亦得預先選任醫療委任代理人，然而此與意定監護契約中約定處理身上照護事務之受任人關係如何，實有釐清之必要。在觀察外國相關立法例，意定監護契約與病患自主意願書之訂立，乃具有密切之關係，故本文將以此為核心，比較我國與德國、瑞士及奧地利相關法制，並從中檢討我國未來施行意定監護制度後之因應措施與方向。
    The Patient Right to Autonomy Act and the Voluntary Guardianship System were implemented simultaneously in 2019. The voluntary guardianship system allows a person to make advance arrangement on the matters of personal care and property management, when he/she still has full capacity to express his/her intent, and after he/she has no capacity to express his/her intent, his/her advanced decisions, can still be followed and his/her autonomy can be ensured. The matters related to medical decisions, especially In the final stage of life, whether it is necessary to refuse to use life extension measures and enjoy the right to a good death is clearly stipulated in the Patient Right of Autonomy Act. According to the law, it is also possible to pre-appoint a medical surrogate agent. However, it is necessary to clarify the relationship between this and the person appointed to handle personal care matters in the voluntary guardianship contract. In observing the relevant foreign legislation, there is a close relationship between the voluntary guardianship contract and the Patient Right of Autonomy Act. Therefore this article will take this as the core to compare the Taiwan law with the relevant legal systems in Germany, Switzerland and Austria, and review the corresponding measures and directions after the implementation of the voluntary guardianship system.
