Title:	黑心食品所涉及的刑法思考—評析金華市金東區人民法院〈二○○四〉金東刑再初字第一號判決

Abstract:	近來黑心食品的氾濫,已經造成兩岸社會人民生活的困擾。基於人民健康的維護,對於部分行為的規範,確實有刑法介入的必要。然而必須注意的是,在刑法謙抑性的思考下,動用國家刑罰權時,一定要顧及行為「應罰性」與「需罰性」所顯現的刑事不法內涵。這一部分的討論,同時也區隔出行政罰與刑罰的不同。在討論相關犯罪類型之刑罰正當的基礎時,本文修正「擬制危險」的觀念,認為事件發生之因果法則的或然率,才涉及風險分配,並影響行為的刑罰可能與犯罪的類型。
