Title:	強制汽車責任保險法的立法破綻－得被保險人同意而使用汽車卻不受保險保障？相關判決綜合評析

Abstract:	強制汽車責任保險法中關於被保險人的定義過於狹隘，未包含經被保險人同意而使用被保險人汽車之人，一方面限縮了保險人的給付責任，另一方面又與同法規定的特別補償基金補償事由脫節。此一現象可能導致經被保險人同意而使用被保險汽車所發生的交通事故，保險人與特別補償基金都無須負責的怪異現象。法院判決也因為立法不當而產生甚為分歧的判決結果。本文研究結果認為，應該擴大解釋被保險人的範圍，把「經被保險人同意而使用被保險汽車之人」納入，歸由保險人負擔給付責任，較能符合保險與特補基金的角色定位，並兼顧被害人與經同意而使用汽車之人的保護。
