Title:	舉證責任實務發展之概觀─以舉證責任減輕之典型案例為中心

Abstract:	我國民事訴訟法之內在規範，在舉證責任相關問題上，係以所謂嚴格證明為基礎。基此所建構之舉證責任規範，結合所預設高度蓋然性之證明度，每因案例類型、事實條件等情狀，對於負擔舉證責任一方極為不利，在部分案例中並形成不公平之結果，有違民事訴訟之理想。因此，理論及實務上乃發展出各種舉證責任減輕之方法，其中以表現證明及酌定損害賠償之數額，屬於典型方法；甚至於嚴重情形，亦得將舉證責任之分配予以轉換。尤其於民事訴訟法增訂第 277 條但書，及修訂第 222 條第 2 項規定後，明定舉證責任減輕之重要根據，在實務運作及理論分析上深具意義。本文嘗試就最高法院近年來之案例，以方法論之觀點，針對所涉問題，提供初步解析。
