Abstract:	因侵權行為所生之損害賠償請求權，自請求權人知有損害及賠償義務人時起，2 年間不行使而消滅，自有侵權行為時起，逾 10 年者亦同。消滅時效，因請求、承認、起訴等事由而中斷。時效完成後，債務人得拒絕給付。民法第 197 條第 1 項、第 129 條第 1 項、民法第 144 條第 1 項分別定有明文。
