    Title: 2005 凱爾生、考古學與法學的論述格局－從大法官處理宗教自由與國家權力衝突的相關論述談起

    Abstract: 本文首先以大法官在釋字四九號所提到的「國家目的」這項概念為例,指出法學義及特別是在憲法解釋學上的論述,其所賴以開展的論述基底,乃在於一個可以稱之為凱爾生的論述格局。本文認為,法學的論述,除了可以根據凱爾生式的論述加以構造之外,事實上,來存在著另一個考古學的論述格局。這兩種論述格局的差異,在於前者強調的,乃是法規範自身的純粹性以及規範的階層構造;後者所著重的,則在於法規範自身所可能擁有特殊的歷史性與文化性。透過對於「國家目的」概念的考古,本文想要說明的是,大法官用來解決宗教自由與國家權利衝突所提出的相關憲法解釋論述,特別是其中有關國家中立性的論述,以及侍者些論述成為可能的凱爾生式論述格局本身,其實都只不過是歐美國去數百來在有關現代國家與立憲主義等歷史脈絡下,所同時用來對於人民與國家權力進行規訓化的措置而已。"
